Language Test Results
Most Common Refusal in 2026
Not uploaded or did not meet requirements.
Outlook: High success rate for reconsideration. Many cases have been reopened and approved. Relies on officer discretion.
Part-Time Studies Outside Final Semester
Typically viewed as ineligibility for PGWP by immigration officers.
Outlook: In very specific situations, IRCC instructions and case-law support maintained eligibility despite part-time studies outside final semester.
Unauthorized Leave of Absence
Taking a leave of absence without proper authorization can result in a finding of non-compliance.
Outlook: In very specific circumstances, IRCC program delivery instructions support that no compliance requirements have been breached, even where an unauthorized leave occurred.
Authorized Leave Beyond 150 Days
Taking an authorized leave of absence over 150 days can result in a finding of non-compliance.
Outlook: Scheduled breaks are not included in the 150 days and in very specific circumstances, IRCC program delivery instructions support that no compliance requirements have been breached, even where an unauthorized leave occurred.
Failing or Repeating Courses
May be interpreted as not actively pursuing studies full-time.
Outlook: Depends on academic record and supporting documentation.
Unauthorized Work or Study
A finding of non-compliance often due to students misunderstanding work/study authorization rules.
Outlook: The IRPR provides exceptions in specific situations such as when 6 months passes and the type of non-compliance. Requires detailed review of personal history and authorization periods.
Invalid Study Permit / No Restoration
Study permit becomes invalid 90 days post-completion or at expiry date, whichever is earlier. Some applicants apply out of status or fail to restore properly.
Outlook: Restoration of status may be an option depending on timing. May need to consider reapplying from abroad.

What Options Exist After PGWP Refusal?

Reconsideration
Typically used when there is clear officer error or when details of the case were not properly assessed.
Judicial Review
Work with an Immigration Lawyer to challenge the decision in Federal Court if there was officer error or procedural fairness issues.
Reapplication + Restoration of Status
If you lost your status following the refusal, you may reapply for a PGWP together with restoration of status, provided you still meet all eligibility requirements.
Reapply From Outside Canada
In some cases, leaving Canada and reapplying may be an option.
